Terms and Conditions
1.0 Miscellaneous - Scope of application
1.1 These General Terms and Conditions apply to the business relationship between S I B E, Im Glattgarten 4, 8304 Wallisellen, Switzerland (hereinafter referred to as “S I B E”) and you for transactions in the online store (wearsibe.com), in the version valid at the time of your respective order.
1.2 Any other general terms and conditions of business of yours shall not apply unless they are expressly agreed in writing in individual cases.
1.3 The term customer refers to any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or independent professional activity.
2.0 Presentation of goods/order processing/conclusion of contract
2.1 Presentation of goods
2.1.1 The presentation of goods in the S I B E online store does not constitute a legally binding offer. Rather, it is a non-binding offer to place an order.
2.1.2 Please note that the actual colors of the items may differ from the colors shown in the online store. You should also note that S I B E clothing may be a half to a whole size smaller than other manufacturers.
2.1.3 All products are supplied without decoration, unless expressly stated otherwise in the product description.
2.2 Order processing
2.2.1 You have the option of selecting products from the online store's range, adding them to the shopping cart and completing the order process step by step.
2.2.2 Before submitting the final order, you can check your details and product selection in an order overview and correct them if necessary.
2.2.3 By clicking on the “Pay now” button, you place a binding order for the goods in your shopping cart. Immediately after sending the order, you will receive an order confirmation by e-mail, which does not yet constitute acceptance of the contract by S I B E.
2.2.4 An order is deemed to have been confirmed as soon as S I B E has dispatched the ordered items and sent you a dispatch confirmation by e-mail.
2.2.5 Orders for items that are not included in the shipping confirmation are not considered confirmed. This may also apply to items that are displayed in the online store and are either not available or sold out at the time of ordering.
2.3 Conclusion of contract
2.3.1 The contract required for the conclusion of the purchase must be concluded in English and is subject to Swiss law, including these General Terms and Conditions, whereby the English version shall prevail. S I B E shall retain the text of the contract in compliance with data protection regulations. You have the option of viewing your current order and order history in your personal customer account under “Account”.
2.3.2 S I B E is entitled, at its own discretion, not to accept orders placed via the S I B E online store. The S I B E online store will notify you immediately if your online order cannot be fulfilled.
3.0 Prices/payment terms/retention of title
3.1 All prices in the S I B E online store are quoted in various currencies and include the statutory VAT applicable at the time of the order and do not include shipping costs. The item prices are the prices listed in the online store at the time of the order.
3.2 S I B E accepts the listed payment methods, such as payment by credit card, as part of the ordering process.
3.3 Various payment methods offered by S I B E in the online store are accepted.
3.4 If you pay by credit card, the amount will be debited from your credit card when you order the goods.
3.5 S I B E reserves the right to retain ownership of the delivered items until the full purchase price has been received.
4.0 Execution of the order

5.0 Shipping
5.1 All information on availability, shipping or delivery of a product are only estimates and are to be understood as approximate guide values. They are not legally binding and/or guaranteed shipping or delivery dates. Should S I B E determine at the time of ordering that the products ordered are not available, you will be informed of this separately by e-mail. No contract is concluded for unavailable goods.
5.2 Unless otherwise agreed, delivery will be made to the delivery address specified by you using the shipping method you have chosen.
5.3 Shipping (standard shipping) is carried out by the following logistics partners: SwissPost, UPS, DHL, FedEx or others.
5.4 Standard shipping: A flat-rate shipping fee is charged for items purchased in the S I B E online store. Shipping to countries outside Europe can take up to 14 days. Customs duties, taxes and charges incurred when shipping to countries outside Switzerland are at your expense. S I B E will inform you of any additional costs if these are known or foreseeable at the time of ordering.
5.5 The delivery period shall be extended in the event of strikes and lockouts as well as in the event of unforeseeable obstacles beyond S I B E's control, such as operational disruptions or delays in the delivery of important materials, insofar as such obstacles demonstrably have a significant impact on the delivery of the item. This shall also apply if the aforementioned circumstances affect subcontractors. The delivery period shall be extended in accordance with the time required to overcome such circumstances and obstacles.
6.0 Special offers and discounts
6.1 Promotional vouchers are vouchers that are issued for promotional purposes and cannot be purchased. In addition, vouchers may have a fixed period of validity and/or only apply from a certain minimum order value (after return).
6.2 Promotional vouchers are subject to the terms and conditions stated on the vouchers, in the email campaigns or on the relevant websites.
6.3 If a minimum order value applies to a promotional voucher, this may not be less than the voucher discount and the returns after deduction. If the minimum order value is not reached, the difference to the minimum order value will be offset against the return amount.
6.4 It is not possible to redeem more than one voucher at a time. Remaining voucher amounts will not be paid out in cash. Vouchers cannot be combined with other discount campaigns or promotions unless this is expressly stated.
6.5 Unless otherwise stated, a voucher can only be redeemed once per person.
6.6 Special price reductions, such as sales promotions or discounts for a specific product group, will take place within a specified period. No subsequent price reductions can be granted on items ordered before the specified period.
7.0 Right of return
7.1 You can return all goods purchased in the S I B E online store together with the necessary return documents within 14 days of receipt. The products must be unused and in their original condition (including packaging), otherwise the return will not be accepted. Due to the high shipping and return costs, a partial amount will be charged for the return: €20 from Germany and €30 from all other countries, which will be deducted from the refundable amount.
7.2 The form that was sent with the order must be completed and enclosed with the order. This also applies to the exercise of the right of withdrawal. The data provided must be complete and legible: Name, address, telephone, e-mail, bank details (for refunds), reason for complaint.
7.3 The goods to be returned must be complete, unused and undamaged, including labels and original packaging.
8.0 Complaints
If an item purchased in the S I B E online store has defects, you can complain about it within the statutory warranty period of 14 days. This also applies to reduced items. Please contact hello@wearsibe.com stating your order number. Our customer service will look into the case and provide you with further information.
9.0 Cancellation policy
9.1 We offer you a voluntary right of return of 14 days, although this is not required by law. The withdrawal period begins on the day on which you or a third party authorized by you take delivery of the goods.
9.2 To exercise your right of withdrawal, please send a letter with a clear statement to the following postal address:

You can use the following sample withdrawal form for this purpose, although this is not mandatory. You can use the form or make another clear declaration. To comply with the withdrawal period, it is sufficient to send the declaration of withdrawal in good time.
9.3 Sample withdrawal form
If you wish to withdraw from the contract, please complete the following sample form and send it back to us:

- I/we hereby cancel the contract that I/we have concluded with regard to the purchase of the following goods.

- Date
9.4 Consequences of withdrawal
In the event of withdrawal from the contract, S I B E must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your decision to choose a type of delivery other than the standard delivery offered by us), within a period of 14 days. The revocation period begins with the receipt of your declaration of revocation by S I B E. The respective amount will be refunded using the payment method you chose for the original transaction.
9.4.1 A refund may be refused until S I B E has received the goods back. The goods must be returned to S I B E immediately, but at the latest within 14 days from the day on which you informed S I B E of your withdrawal from the contract.
9.4.2 All direct costs for returning the goods shall be borne by you.
9.4.3 You are only obliged to pay compensation for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to check the condition, properties and functionality of the goods.
10 Warranty
10.1 If goods are delivered with visible damage to the packaging or contents, you are obliged, irrespective of your warranty rights, to complain immediately to the relevant transport company and refuse acceptance. Then immediately contact customer service at hello@wearsibe.com and provide us with your order number.
In this way, S I B E has the opportunity to assert its liability claims against the respective transport company.
10.2 The transfer of risk to you takes place when the item is dispatched.
10.3 Liability for defects shall be governed by the applicable statutory provisions. This is without prejudice to the right of withdrawal under section 9. The limitation period for statutory claims for defects is two years from the date of delivery of the goods to you.
11 Liability
11.1 S I B E shall be liable in all contractual and non-contractual cases in the event of intent and gross negligence; in the event of simple negligence, only for damages resulting from injury to life, limb, health or a material contractual obligation.
11.2 An essential contractual obligation is an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance you may rely. In the event of non-compliance with this obligation, S I B E's liability shall be limited to compensation for damages typically foreseeable at the time the contract was concluded.
11.3 The limitations of liability resulting from the above shall not apply if we have fraudulently concealed a defect or have assumed a guarantee for the quality of the goods. The same applies to your claims under the Product Liability Act.
12 exclusion of liability for external links
12.1 Our website may contain links to external websites of other providers over whose content we have no influence. S I B E therefore accepts no liability for the content of linked pages. The respective service provider or site operator is always responsible for the content of linked sites.
12.2 However, it is not possible to constantly check the content of these linked pages, and it is therefore unreasonable to assume an infringement of the law without concrete evidence. In the event that we become aware of any legal infringements, we will remove such links immediately.
13 Data protection
S I B E attaches great importance to lawful data processing aimed at protecting your personal data (see Data protection). We comply with the provisions of the Swiss Data Protection Act (DSG). If you are resident within the European Union, data processing is carried out in compliance with the provisions of the General Data Protection Regulation
14 Applicable law and place of jurisdiction
14.1 Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision or loophole in the General Terms and Conditions shall be replaced by an appropriate provision that comes as close as possible to the meaning and purpose of the invalid provision.
14.2 All contracts shall be governed exclusively by Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The mandatory statutory provisions of the country in which you have your habitual residence remain unaffected.
14.3 The contract is concluded in English, even if the General Terms and Conditions are also translated into other languages.
14.4 The following provisions apply to the place of jurisdiction.
